Examination Regulations Scott Haldane Foundation (SHF)

 

Chapter 1 – General Provisions


Article 1 – Purpose and Scope


These regulations set out rules regarding the organisation, administration, and assessment of examinations of the Scott Haldane Foundation (hereinafter: SHF).
These regulations apply to all candidates participating in an examination organised by SHF.


Article 2 – Definitions

In these regulations, the following terms shall mean:
Candidate: a person participating in an SHF examination;
Course Director: a person appointed by the Board responsible for organising the course and examination;
Board: the governing body of SHF (competent authority);
Examination Committee: the committee referred to in Article 5;
Complaints Committee: the committee referred to in Article 15;
Appeals Committee: the committee referred to in Article 18;
SHF Officials: persons responsible for supervision during the examination;
Examination: assessment of knowledge and/or skills within a course;
Independent Third Party: a person appointed by the Board who is not a member of the Examination Committee and has no voting rights in decision-making.
Chapter 2 – Admission and Organisation
Article 3 – Admission to the Examination
A candidate shall be admitted to the examination if, in the opinion of the Course Director, they have sufficiently attended and completed the relevant course.
The examination forms an integral part of the course.
Payment of the course fee entitles participation in the examination.
Participation in a resit requires separate registration and prior payment of the applicable examination fee.
Article 4 – Organisation of the Examination
The examination is conducted immediately following the course or training day.
The resit shall, in principle, take place during a subsequent course.
The Examination Committee may decide to organise a separate resit.
The candidate is entitled to a maximum of two resits.
Participation shall take place in person only, unless otherwise decided by the Examination Committee.
Chapter 3 – Examination Committee
Article 5 – Establishment and Composition
An Examination Committee shall be established by the Board.
The Examination Committee consists of:
a. the Course Director;
b. at least one instructor of the relevant course.
Article 6 – Duties and Powers

The Examination Committee is responsible for:
a. supervising the quality and organisation of examinations;
b. assessing examinations and determining results;
c. handling objections;
d. taking measures in case of irregularities.

Chapter 4 – Conduct of the Examination
Article 7 – Supervision and Administration
The examination is prepared under the responsibility of the Course Director.
Examination questions are derived from a validated question bank.
SHF Officials shall be present during the examination.
During both the administration and assessment of the examination, an Independent Third Party shall be present as an external supervisor. This person is not a member of the Examination Committee and has no voting or decision-making authority.
Article 8 – Conduct During the Examination
The candidate must provide identification upon request.
Examination time will not be extended in case of late arrival.
The candidate must follow the instructions of SHF Officials.
The candidate must behave respectfully.
The Examination Committee may decide to exclude a candidate and invalidate the examination in case of inappropriate behaviour.


Chapter 5 – Irregularities
Article 9 – Reporting and Assessment
Irregularities include any behaviour or circumstance that may affect the fair conduct of the examination.
SHF Officials shall report suspected irregularities to the Examination Committee.
The candidate shall be heard before a decision is taken.
Article 10 – Measures
The Examination Committee may take appropriate measures, including:
a. exclusion from further participation;
b. invalidation of the examination.


Chapter 6 – Assessment and Results
Article 11 – Assessment
Assessment is based on the number of correctly answered questions.
The examination is passed with a score of at least 70%.
Article 12 – Deviation and Results
The Examination Committee may deviate from the standard where justified.
The result shall be communicated to the candidate as soon as possible.


Chapter 7 – Legal Protection and Complaints
Article 13 – Separation of Procedures
These regulations provide for three separate procedures:
a. objection;
b. complaint;
c. appeal.
These procedures may not be combined.
Article 14 – Objection (Examination Content)
Decisions of the Examination Committee regarding assessment, results, or conduct of the examination may be contested by objection.
Objections must be submitted in writing to the Board within four weeks.
The Examination Committee shall reconsider the decision.
Reconsideration may result in confirmation, amendment, or withdrawal of the decision.
Article 15 – Complaints Committee
A Complaints Committee shall be established by the Board of SHF.
Members are appointed by the Board.
The committee consists of:
a. an Independent Third Party (chair);
b. a subject-matter expert;
c. a Board-appointed person not involved in the case.
Members act independently and without instruction.
The committee handles complaints regarding organisation, execution, and conduct within SHF courses and examinations.
The committee does not handle objections regarding examination results or content.
The committee advises the Board of SHF.
Article 16 – Complaint Procedure
Complaints must be submitted in writing within four weeks after the incident.
Receipt is confirmed within two weeks.
The committee investigates and may hear involved parties.
Advice is issued within four weeks after receipt.
The Board makes a decision and informs the complainant in writing.
Article 17 – Appeals Committee
The Board establishes an independent Appeals Committee.
The committee consists of:
a. a legal expert (chair);
b. an independent expert;
c. a Board member.
Article 18 – Appeal
An appeal may be lodged against the decision on an objection.
Appeals must be submitted within four weeks.
The Appeals Committee decides within four weeks.
The decision is binding within SHF, without prejudice to judicial review.


Chapter 8 – Miscellaneous Provisions
Article 19 – Confidentiality
All persons involved in the implementation of these regulations are bound by confidentiality.
This obligation applies in particular to examination questions and personal data.
Article 20 – Fees
The Board determines fees for courses and examinations.
Fees are published via the website or registration form.
Applicable fees are binding upon registration.
Article 21 – Unforeseen Circumstances
In cases not provided for in these regulations, the Board shall decide.

These regulations may be cited as:
